These Terms of Service govern your use of wahibitsolutions.com and any services provided by Wahibit Solutions LLC. By using this site or engaging our services, you agree to these terms.

1. Services

Wahibit Solutions LLC provides Linux engineering services on a contract, retainer, or project basis, and direct hire placement services for Linux engineering roles. The specific scope, deliverables, timelines, and fees for any engagement are defined in a separate Statement of Work (SOW) or service agreement agreed upon by both parties in writing.

2. Use of This Website

You may use this website for lawful purposes only. You agree not to:

  • Attempt to gain unauthorized access to our systems or servers
  • Submit false or misleading information through the contact form
  • Use this site to transmit malicious code or conduct security attacks
  • Reproduce, copy, or redistribute our content without written permission

3. Engagements & Payment

All service engagements require a signed Statement of Work or service agreement before work begins. Payment terms are as specified in that agreement. For fixed-price projects, a 50% deposit is due at project start and the remaining 50% upon delivery. For hourly work, invoices are issued weekly. For retainers, invoices are issued at the start of each billing period.

Late payments may accrue interest at 1.5% per month or the maximum rate permitted by Texas law, whichever is lower.

4. Direct Hire Placement

Placement fees for direct hire engagements are agreed upon in writing prior to candidate presentation. The placement fee is due upon the candidate's first day of employment. A 90-day replacement guarantee applies: if the placed candidate leaves or is terminated within 90 days for performance reasons, we will conduct one additional search at no additional charge, provided the fee has been paid in full.

5. Intellectual Property

Upon full payment, all custom work product created specifically for your engagement (scripts, playbooks, documentation) becomes your property. We retain the right to use general methodologies, techniques, and knowledge gained during an engagement for future work. Pre-existing tools, templates, or code libraries we bring to the engagement remain our property unless otherwise agreed in writing.

6. Confidentiality

We treat all client information as confidential. We will not disclose your systems, configurations, business information, or credentials to third parties without your written consent, except as required by law. This obligation survives the termination of any engagement.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Wahibit Solutions LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from our services or your use of this website. Our total liability for any claim arising from an engagement shall not exceed the total fees paid by you in the three months preceding the claim.

8. Warranty Disclaimer

This website and its content are provided "as is" without warranties of any kind, express or implied. We do not warrant that the site will be uninterrupted or error-free. Our engineering services are performed with professional care and skill, as described in each engagement's SOW.

9. Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Harris County, Texas, and both parties consent to that jurisdiction.

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date. Continued use of our services after changes are posted constitutes acceptance.
